Unofficial 'Super Mario 64' HD Remake In Development Halted By Nintendo

It seems Atari isn't the only entity issuing cease and desist legal warnings at the moment, as news has begun to circulate that a promising fan-made HD remake of Super Mario 64 has been taken off various hosting sites at the request of the Japanese firm.

The Super Mario 64 HD remake was featured on RetroCollect several months ago, and since then a playable demo of the N64 flagship's first level, Bob-Omb Battlefield had been made availible for gamers to download. Running in the Unity engine, Super Mario 64 HD allowed players to experience a completely remade carbon copy of the original game's opening stage, complete with re-imagined music and new physics, but without a hint of the N64's angular and somewhat blurry visuals.

It appears that Nintendo has taken a dim view of this fan-made homage to one of it's finest titles however, and has issued the demo's creator Royston Ross with a takedown notice, citing a breach of copyright for "Nintendo's Super Mario 64 video game (U.S. Copyright Reg. No. PA0000788138), including but not limited to the audiovisual work, computer program, music, and fictional character depictions." To this end, Ross has removed all download links from his Wordpress blog, and the only way to currently enjoy his impressive work is by watching the YouTube clip below.

Fair enough that there are copyright issues on this HD remake but in my opinion this is just Nintendo being cruelly unfair towards future game developers.
